Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Dazzling Works LLC ("Dazzling Works," "we," "us," or "our") governing your use of any mobile application published by Dazzling Works under the Dashing Photos brand (each an "App," collectively the "Apps").

By downloading, installing, or using any App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this age requirement.

Service Description

Our Apps use artificial intelligence to process and enhance photos. Users upload photos to our servers for AI processing, and processed versions are returned to the user.

Subscription Plans & Pricing

Free Tier

  • We may offer a limited number of free credits at our discretion
  • Free credits may be modified, limited, or discontinued at any time without notice
  • No subscription or payment is required to use free credits

In-App Purchases (One-Time)

  • One-time in-app purchases such as download packs may be available within the App
  • These are consumable purchases that provide a set number of credits or features
  • No subscription required — only pay for what you want
  • Pack details and pricing are displayed in the App before purchase
  • Credits from in-app purchases don't expire

Subscription Plans

  • Subscription plans with unlimited access are available within the App
  • Plan details, pricing, and features are displayed in the App before purchase
  • Subscription features and pricing may change — current terms are always shown in the App

Credit System

How Credits Work

  • Credits may be consumed when you use the App's AI processing or download features
  • Credit costs are shown before you confirm each operation
  • The App may use separate credit types for different features (e.g., generation credits, download credits)
  • Credits from in-app purchases don't expire

Important Credit Policies

  • All credits are tied to your device
  • Credits are non-transferable between devices
  • Credits are non-refundable once used
  • If you uninstall or reinstall the App, or switch to a new device, you may lose your remaining credits. The App does not use user accounts — credits are associated with your device identifier, which may change.
  • All unused subscription credits EXPIRE immediately when your subscription ends or is canceled
  • Free credits are provided at our discretion and may be revoked at any time

Subscription Terms

Billing & Renewal

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • Renewal price equals the current subscription price at time of renewal

How to Cancel

iOS:

  1. Open the Settings app on your iOS device
  2. Tap your name at the top
  3. Tap Subscriptions
  4. Select the App and tap Cancel Subscription

Android:

  1. Open the Google Play Store app
  2. Tap your profile icon, then Payments & subscriptions
  3. Tap Subscriptions
  4. Select the App and tap Cancel subscription

Cancellation takes effect at the end of your current billing period. You retain access until then.

Refund Policy

  • No refunds for partial subscription periods
  • Refund requests must be directed to Apple or Google through the respective app store
  • We cannot process refunds directly as payments are handled by the platform provider

User Content

By uploading photos to the App, you represent and warrant that:

  • You own or have the necessary rights, licenses, and permissions to upload and use the content
  • The content does not infringe on any third party's intellectual property, privacy, publicity, or other rights
  • The content complies with all applicable laws and regulations in your jurisdiction
  • The content is appropriate and does not contain illegal, obscene, hateful, defamatory, or otherwise objectionable material
  • The content does not depict minors in any inappropriate context
  • You are using the App and its outputs for personal, non-commercial use only unless you have obtained our prior written consent

You are solely responsible for the content you upload and how you use the outputs generated by the App. We do not review content before processing and assume no responsibility for user-uploaded material. We reserve the right to remove any content and terminate access to any user who violates these requirements, without notice or refund.

Photo Processing & Data Use

  • Photos you upload are sent to our servers for AI processing
  • Photos are stored on our servers for processing and to provide the service
  • Photos may be used to improve our AI photo enhancement technology and develop new features
  • Photos are NOT sold or shared with third parties
  • Processing times vary based on server load (typically seconds to a few minutes)
  • No guarantee of specific results — AI processing quality varies depending on the source image
  • Always keep your original photos — we are not responsible for lost or corrupted files

Acceptable Use

You agree NOT to:

  • Upload illegal content or content that violates any applicable laws
  • Upload content you do not have the rights to use
  • Attempt to abuse, exploit, or circumvent the credit system
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use the App or its outputs for any commercial purpose without our written consent
  • Interfere with or disrupt the integrity or performance of the App or its servers
  • Attempt to gain unauthorized access to the App or its related systems

We reserve the right to terminate or suspend access to the App for users who violate these terms.

Intellectual Property & License Grant

  • The App, including its design, features, and content, is owned by Dazzling Works LLC
  • You retain ownership of the photos you upload
  • By uploading photos to the App, you grant Dazzling Works LLC a non-exclusive, worldwide, royalty-free license to use, store, process, reproduce, and create derivative works from your photos for the purposes of: (a) providing and operating the service, (b) improving our AI photo enhancement technology, and (c) developing new features and products
  • This license survives deletion of your photos from the service and termination of your account

Assumption of Risk

The App uses artificial intelligence to generate processed images. AI-generated outputs may be inaccurate, unexpected, or unsuitable for your intended purpose. You acknowledge and accept the inherent risks of using AI-generated content, including but not limited to: altered appearances, unintended modifications, artifacts, or distortions. You are solely responsible for reviewing AI outputs before using or sharing them. We are not liable for any consequences arising from your use of AI-generated content, including claims by third parties.

Indemnification

You agree to indemnify, defend, and hold harmless Dazzling Works LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App, (b) content you upload to the App, (c) your use of any AI-generated outputs, (d) your violation of these Terms, or (e) your violation of any applicable laws or third-party rights.

Service Modifications

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App. Features, credit amounts, processing capabilities, and AI models may change at any time.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. We make no guarantees regarding the quality, accuracy, or results of any AI processing.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAZZLING WORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN SUBSCRIPTION FEES AND IN-APP PURCHASES DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Termination

  • We may terminate or suspend your access to the App at any time, for any reason, with or without cause and with or without notice
  • You may cancel your subscription at any time through your device's app store settings
  • Upon termination, all unused credits are forfeited immediately
  • Sections regarding User Content, Intellectual Property, Assumption of Risk, Indemnification, Disclaimer of Warranties, Limitation of Liability, and Governing Law survive termination

Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved through binding individual arbitration, rather than in court, except that either party may seek injunctive relief in court for intellectual property matters.

  • CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action
  • Arbitration shall be conducted under the rules of the American Arbitration Association (AAA)
  • The arbitrator's decision shall be final and binding
  • You may opt out of this arbitration agreement by contacting us within 30 days of first using the App

Changes to Terms

We may update these Terms at any time without prior notice. Changes take effect immediately upon posting to this page. We encourage you to review these Terms periodically.

Your continued use of the App after any changes constitutes acceptance of the new Terms.

Our Privacy Policy may also be updated at any time without prior notice.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dazzling Works LLC regarding your use of the App and supersede all prior agreements, understandings, and communications, whether written or oral.
